Yes, the law is not straightforward on the issue and people that just assume these are unenforceable are wrong. They are enforceable.

The point is that it is more often than not uneconomical for them to raise the court action to recover it.

That Dundee case was all about whether £100 (or whatever it was) was a reasonable charge for a parking company to levy. Proof of the identity of the driver was never in question. It's not relevant to the OP's situation.

I've only had one private one with a letter and they got the hotel name wrong so wasn't bothered either way.

Sorry, I'm not sure why the appeal failed they didn't explain in the letter it just made reference to our appeal and that it had been rejected.

Been back to talk to HR at his work and they have around 20 of these causing an issue at that branch at the moment. Whatever their process is for registering a registration seems to be failing at some point.

His company are trying to resolve it so I'll let it play out a bit longer and see what happens.

There's a good chance I'll be a massive wimp and pay it if they actually take court action

They won't take court action.

I got a letter about a year ago threatening court action and all they ever do is phone my parents house now and again asking for me.

What is the company called that's chasing it?

It was originally from UK Parking Control but the letters are now coming from debt recovery plus ltd

Got a letter today from Smart Parking, wanting me to pay a £100 fine for an incorrect payment. I payed them £1 because their machines were more complicated than the ISS and all I could get it to charge me was either £1 or £36.

Going to ignore it, going by this thread I’ll be fine.

Had the same when the other half fucked up with the new parking system in the Dunfermline multi story and hadn’t paid the right amount

Get a letter every few weeks for about 8-9 months and nothing came from it
